In allowing the plaintiff’s application for mareva injunction after Summary Judgment can obtained against the defendants, the Court held that the plaintiff has a good arguable case as summary judgment was obtained. The Court held that given the defendants’ failure to disclose the bank account and the real trail of funds given by the plaintiff, there was a real risk that the defendants will dissipate their assets. The plaintiff ought not to be denied from obtaining the fruits of the judgment as the purpose of the mareva injunction is to prevent the defendants from removing their assets.
